A driver charged in a collision that killed an 82-year-old Las Vegas man admitted taking drugs, told police he was a gang member and would kill officers if given the chance.

That's according to an arrest report for 29-year-old Jose Gomez, who was arrested Thursday after the collision at Charleston and Jones boulevards.

The victim, 82-year-old Robert Foster, was a passenger in a 2001 Lincoln Town Car that was struck by Gomez's 1995 GMC Suburban.

The driver of the Lincoln, 78-year-old Geneva Foster, suffered critical injuries in the crash.

Police said Foster was making a left turn from Jones onto Charleston when the Suburban struck the right side of Lincoln.

While being treated at the scene, authorities said Gomez was attempting to resist and officers and tried to leave.

"Mr. Gomez appeared to be impaired by a substance other than an alcoholic beverage, based on his slurred speech and abnormal behavior," police wrote in the report.

When he was questioned later at University Medical Center, Gomez admitted he had taken the medications Xanax and Lortab, but did not have a prescription, according to the report.

Police said he also admitted to running the red light, and told officers, "The other driver should have swerved out of the way, since he was running a red light and he had no liability."

After failing six field sobriety tests administered at UMC, Gomez was arrested and charged with DUI causing death, failure to obey a red light, driving without a valid license and no proof of insurance.

According to the arrest report, Gomez identified himself to police as a member of the Serentos Gang, and "his father was a member of the Mexican Mafia, and if he was given the opportunity he would kill police officers once the handcuffs were removed.
